വിമാനതാവളത്തിലെ പരിശോധനയില്‍ തങ്ങളുടെ ലഗേജില്‍ മയക്കുമരുന്ന് കണ്ടതിനെ തുടര്‍ന്ന് പിടിക്കപ്പെട്ട മുംബൈ സ്വദേശികളായ ഒനിബ ഖുറൈശി, മുഹമ്മദ് ഷാരിഖ് ഖുറേഷി എന്നിവര്‍ക്ക് പത്ത് വര്‍ഷം തടവും ഒരു കോടി രൂപ പിഴയും വിധിച്ച് കഴിഞ്ഞ ഒരു വര്‍ഷത്തിലധികമായി ജയിലിലാണ് .
കോടതിയുടെ വിധിയില്‍ ന്യൂനതയുണ്ടെന്ന് നിരീക്ഷിച്ചതിനെ തുടര്‍ന്നാണ് അപ്പീല്‍ കോടതിയില്‍ പുതിയ ബെഞ്ചിനു കീഴില്‍ കേസ് വീണ്ടും പരിശോധിക്കണമെന്ന് ഉത്തരവിട്ടത്.
2019 ജൂലൈയിലാണ് കേസിന് ആസ്പദമായ സംഭവം നടന്നത്. ഷാരിഖിന്റെ അമ്മായി തബസ്സും റിയാസ് ഖുരൈശി സമ്മാനിച്ച ടൂര്‍ പാക്കേജില്‍ മുമ്പൈയില്‍ നിന്നും ദോഹയിലെ ഹമദ് അന്താരാഷ്ട്ര വിമാനത്താവളത്തില്‍ എത്തിയ ദമ്പതികളുടെ പക്കലുണ്ടായിരുന്ന ബാഗില്‍ നിന്ന് അധികൃതര്‍ 4.1 കിലോഗ്രാം ഹാഷിഷ് കണ്ടെടുക്കുകയായിരുന്നു.
യാത്ര പുറപ്പെടുമ്പോള്‍ തബസ്സും ഇവരുടെ കൈവശം ഒരു പാക്കറ്റ് ഏല്‍പ്പിക്കുകയായിരുന്നു. ഇത് ഖത്തറിലുള്ള ഒരു സുഹൃത്തിന് നല്‍കാനാണെന്നും ഇതില്‍ പുകയിലയാണെന്നുമാണ് തബസ്സും പറഞ്ഞു. അമ്മായിയെ അവിശ്വസിക്കുകയോ സംശയിക്കുകയോ ചെയ്യേണ്ട സാഹചര്യമുണ്ടായിരുന്നില്ല .
ഗര്‍ഭിണിയായിരുന്ന ഒനീബയും ഷാരിഖും ഏറെ സന്തോഷത്തോടെയാണ് ദോഹയില്‍ വന്നിറങ്ങിയത്. എന്നാല്‍ അമ്മായി നല്‍കിയ ആ പാക്കറ്റിലുണ്ടായിരുന്ന മയക്കുമരുന്ന് നിരപരാധികളായ ഈ ദമ്പതികളുടെ ജീവിത സ്വപ്‌നങ്ങള്‍ക്കുമേല്‍ ഒരു ഇടത്തീയാവുകയായിരുന്നു. സ്വാഭാവികമായും കേസ് കോടതിയിലെത്തിയപ്പോള്‍ ഇവര്‍ക്കെതിരെ മയക്കുമരുന്ന് കടത്തിയ കുറ്റത്തിനുള്ള ശിക്ഷയാണ് കോടതി വിധിച്ചത്.
ദമ്പതിമാര്‍ അറസ്റ്റിലായി ശിക്ഷിക്കപ്പെട്ട ശേഷം ഷാരിഖിന്റെ പിതാവ് ഷരീഫ് ഖുറേഷി ഖത്തറിലെത്തി ഇരുവര്‍ക്കുമായി ഒരു അഭിഭാഷകനെ നിയമിച്ചിരുന്നു. ഷാരിഖും തബസ്സുമും തമ്മിലുള്ള ഫോണ്‍ സംഭാഷണത്തിന്റെ ശബ്ദരേഖ ഹാജരാക്കി. ഈ ശബ്ദരേഖയില്‍ തബസ്സും ഇവരെ ഖത്തര്‍ സന്ദര്‍ശിക്കാനായി നിര്‍ബന്ധിക്കുന്നതും പുകയില പാക്കറ്റിന്റെ കാര്യം സംസാരിക്കുന്നതും വ്യക്തമായി കേള്‍ക്കാമായിരുന്നു.
എന്നാല്‍ ഈ തെളിവ് ഹാജരാക്കിയിട്ടും അപ്പീല്‍ കോടതി 2020 ജനുവരി 27 ന് ദമ്പതികളുടെ അപേക്ഷ നിരസിക്കുകയും വിചാരണ കോടതിയുടെ വിധി ശരിവയ്ക്കുകയും ചെയ്തു. 2020 ഫെബ്രുവരിയില്‍ ഒനിബ ജയിലില്‍ വച്ച് അയാത് എന്ന പെണ്‍കുഞ്ഞിന് ജന്മം നല്‍കി.
ഷാരിഖിന്റെ പിതാവ് ഖയ്യൂം രക്ഷപ്പെടുന്നതിനുള്ള മാര്‍ഗങ്ങളന്വേഷിച്ചു. അങ്ങനെയാണ് പ്രമുഖ ഇന്ത്യന്‍ അഭിഭാഷകനും സാമൂഹ്യ പ്രവര്‍ത്തകനുമായ അഡ്വ. നിസാര്‍ കോച്ചേരിയുടെ നിയമോപദേശത്തിന്റെ അടിസ്ഥാനത്തില്‍ ഇന്ത്യയില്‍ കേസ് കൊടുത്തത്. ഇന്ത്യന്‍ നാര്‍കോട്ടിക് കണ്‍ട്രോള്‍ ബ്യൂറോയുടെ അന്വേഷണത്തില്‍ ഷാരിഖിന്റെ അമ്മായിയായ തബസ്സും ഖുറൈഷി മയക്കുമരുന്ന് കടത്ത് സംഘത്തിലെ കണ്ണിയാണെന്ന് തെളിഞ്ഞതാണ് സംഭവത്തില്‍ വഴിത്തിരിവായത്. തുടര്‍ന്ന് തബസ്സും ഖുറൈശിയും സഹായിയും ഇന്ത്യയില്‍ അറസ്റ്റിലായതോടെ ഷാരിഖും ഒനിബയും വഞ്ചിക്കപ്പെട്ടതാണെന്ന് ബോധ്യപ്പെട്ടു. ഈ സാഹചര്യത്തില്‍ ദമ്പതികളുടെ മോചനത്തിന് ഇന്ത്യന്‍ ആഭ്യന്തര മന്ത്രാലയവും വിദേശ മന്ത്രാലവും എല്ലാ സഹായസഹകരണങ്ങളും നല്‍കി.
2021 ജനുവരി 11 ന് കോര്‍ട്ട് ഓഫ് കാസേഷന്‍ (ക്രിമിനല്‍ ഡിപ്പാര്‍ട്ട്മെന്റ്) മേധാവി ജസ്റ്റിസ് ഹമദ് മുഹമ്മദ് അല്‍ മന്‍സൂരിയുടെ അധ്യക്ഷതയിലുള്ള ബെഞ്ച് കേസില്‍ വാദം കേള്‍ക്കുകയും അപ്പീല്‍ കോടതിയുടെ വിധിയില്‍ തെറ്റുണ്ടെന്ന് നിരീക്ഷിക്കുകയും ചെയ്തു. കുറ്റാരോപിതര്‍ക്ക് ക്രിമിനല്‍ ഉദ്ദേശങ്ങള്‍ ഇല്ലായിരുന്നുവെന്നും ഇവരില്‍ നിന്ന് പിടിച്ചെടുത്ത വസ്തു മയക്കുമരുന്നാണെന്ന് ഇവര്‍ക്ക് അറിയില്ലായിരുന്നുവെന്നും പരമോന്നത കോടതി വ്യക്തമാക്കി.
ദമ്പതിമാര്‍ ഹാജരാക്കിയ തെളിവുകള്‍ പ്രാധാന്യമുള്ളതാണെന്ന് കോടതി നിരീക്ഷിച്ചു. ഇവ പരിഗണിക്കാതെയാണ് അപ്പീല്‍ കോടതി വിചാരണ കോടതിയുടെ വിധി ശരിവച്ചത്. അതിനാല്‍ കോടതിക്ക് ഇത് സ്വതന്ത്രമായി പരിശോധിക്കേണ്ടി വന്നു. വിഷയം സൂക്ഷ്മമായി പരിശോധനിക്കുവാന്‍ മറ്റൊരു ബെഞ്ചിനു കീഴില്‍ വാദം കേള്‍ക്കണമെന്ന് വിധിച്ചുകൊണ്ട് കോടതി കേസ് മടക്കുകയായിരുന്നു. ഇതോടെ ചെയ്യാത്ത കുറ്റത്തിന് ജയില്‍ശിക്ഷയനുഭവിക്കുന്ന ഇന്ത്യന്‍ ദമ്പതികളുടെ മോചന വിഷയത്തില്‍ പ്രതീക്ഷയേറുകയാണ്.
2018 ലാണ് ഷാറിഖും ഒനീബയും വിവാഹിതരായയത്. ആദ്യ ഹണി മൂണ്‍ ബാങ്കോക്കിലേക്കായിരുന്നു. 2019 ല്‍ അമ്മായി സമ്മാനിച്ച രണ്ടാം മധു വിധുവാണ് അവരെ ജയിലിലെത്തിച്ചത്. രണ്ട് പേരുടേയും മാതാപിതാക്കളും നിരന്തരമായ നിയമപോരാട്ടത്തിന് തയ്യാറാവുകയും ലഭ്യമായ എല്ലാ സേവനങ്ങളും പ്രയോജനപ്പെടുത്തുകയുമായിരുന്നു.
